Understanding DUI/DWI Violations
In New Jersey and Pennsylvania, drivers with blood alcohol concentration (BAC) of .08 percent or higher can be charged with a DUI. Penalties of a conviction include license suspension, possible jail time, mandatory counseling, and significant fines and surcharges. Repeat offenders, drivers under age 21, and anyone caught driving with a BAC of .10 or higher in New Jersey or .16 or above in Pennsylvania may also face more severe consequences. Refusing to provide a breath or blood sample also carries harsh penalties. In Pennsylvania, those who refuse to submit to testing are automatically charged with the highest BAC level.
